AN ORDINANCE OF THE CAROL STREAM PARK DISTRICT DUPAGE COUNTY
STATE OF ILLINOIS, AMENDING ORDINANCE NO. 222 DATED 27; AUGUST 1990
AND RESTATING THE REGULATIONS AND RESTRICTIONS GOVERNING THE USE
OF THE PARK SYSTEM OF THE CAROL STREAM PARK DISTRICT.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF COMMISSIONERS
OF THE CAROL STREAM PARK DISTRICT, THAT ORDINANCE NO. 222 IS
HEREBY AMENDED AND THE FOLLOWING REGULATIONS AND
RESTRICTIONS GOVERNING THE USE OF THE PARK SYSTEMS ARE
HEREBY RESTATED AND ADOPTED:
No person shall allow to be loose upon park premises any animal, except that dogs may
be taken into the Park System provided they are held by a suitable line, chain or strap
capable of maintaining physical control over their dog.
No person shall allow a pet, being dog, cat, or any other animal which he or she owns or
controls to defecate on park district property. In the event such dog, cat, or other animal
defecates on Park District property, the person shall immediately remove the excrement
from Park District property.
No person shall bring their animal; dog, cat or any other animal onto Park District
property during organized events sponsored by the park district; I.E.; 4TH OF JULY,
LABOR DAY, or any other festivities where a large crowd may gather.
No person at any time shall have in their possession or on or about their person, vehicle
or any other conveyance, concealed or otherwise, any firearm, stun gun, taser, bow and
arrow, slingshot, cross bow, spear, or spear gun, switch blade knife, stiletto, sword,
blackjack, billy club, martial arts weapon or any air rifle, paint gun or devise capable of
discharging a projectile of harmful chemical substance, or any weapon, instrument, or
substance of like character or design except at those areas designated for their use by the
executive director and then only in accordance with the rules and restrictions duly set
forth for the proper use of such areas. Nothing contained herein shall be construed to
prevent any ranger, police officer, or any other duly sworn peace officer from carrying
such weapons as may be authorized and necessary in the discharge of their duties, nor
shall it apply to any person summoned by any such officer to assist in making arrests or
preserving the peace while such person is engaged in assisting such officer.
It shall be unlawful on any park district area for any person to light, discharge, detonate,
or set off any type of fireworks, or any device capable of creating a loud or unusual
noise, explosion, flash or smoke.
It shall be unlawful on any Park District area for any person to possess any type of
explosive device, or any type of electrical or electronic device that could be capable of
detonating an explosive device.
Except when and where permitted by special Park District programs, it shall be
specifically unlawful for any person to use or possess any type of fireworks,
pyrotechnics or explosives, or to put on a display of such items.
a) No person shall throw or cast any stones or other missiles within the Park System.
Where allowed, water craft shall be used in accordance with district rules, regulations
and restrictions duly set forth as part of such permit or as posted, as well as all
applicable statutes of the STATE OF ILLINOIS and the UNITED STATES.
Only those park waters designed as boating areas will be used for such purposes. No
motorized boat shall be allowed in park waters. No person shall operate a vessel on park
waters unless a permit is obtained from the Park District office.
No person shall swim, bathe, or wade in any water or waterway in or adjacent to any
park, except in such public swimming pools during such hours as the Park District may
designate and in accordance with the terms of this ordinance and any other regulations
as set forth by the Board of Commissioners.
No person shall allow their pets to swim, bathe or wade in any water or waterway in or
adjacent to any park.
No person shall interfere with or in any manner hinder any employee of the Park District
while engaged in construction, repairing or caring for any park property.
No person shall interfere with or in any manner hinder any employee, volunteer, or
authorized agent of the Park District while engaging as an instructor, coach, coordinator,
facilitator, or the like in a Park District sponsored program, class, league or event.
No person shall offer or exchange for sale any article or thing or do any hawking,
peddling or soliciting, or buy or offer to buy an article or thing, or take up any collection
or solicit or receive contributions of money or anything of value in the Park System,
except when authorized to do so by permit from or contract with the board of
commissioners.
No person shall expose or offer for sale to the general public any articles or things, or
conduct to solicit any business, trade or occupation or profession without a valid
concession license agreement approved by the Director and then only in accordance with
the terms and conditions thereof, it being the intention to control commercial enterprises
or sales on District Property.
No person shall display, distribute, post or fix any placard, sign, handbill, pamphlet,
circular or any other writing or printed material of any kind whatsoever, without written
permission of the Director, except that groups holding a valid Picnic, Camping or
Special Event Permit may display signs to identify their location or direct others to it,
providing that such signs are no larger than 18" x 24" and are not attached to any tree or
shrub or any post, building, District sign, gate or other structure.
No person shall call or hold any public meeting or give any concert or public
entertainment of any kind in the Park System without the express consent of the Board
of Commissioners.
No person shall enter upon any portion of the Park System where persons are prohibited
from going as indicated by sign, notice or any type of barrier.
No person shall beg or solicit alms in the Park System.
No person shall camp, or place a swing, tent or shelter, or occupy or use any hammock
therein, without the express consent of the Executive Director of Parks.
No person, over 12 years of age, shall in any manner use any of the playground
apparatus or devices meant exclusively for the use of children.
No person shall light or make use of any fire in the Park System except such portions
thereof as may be designated.
No person under the influence of any intoxicating liquor,
drug, narcotic or controlled substance shall enter, be or remain in the Park System nor
shall any person bring within, possess, sell, give away, drink, consume or use any
alcoholic beverage, drug, narcotic or controlled substance in the Park System.
- "Cannabis" includes marijuana, hashish and other substances which are
identified as including any parts of the plant Cannabis Sativa, whether growing
or not; the seeds thereof, the resin extracted from any part of such plant; and any
compound manufacture, sales, derivative, mixture, or preparation of such plant.
- It shall be a violation of this section for any person to knowingly
possess in the Park system, any quantity of any substance containing cannabis,
except that the effect of this Ordinance shall be limited to persons knowingly
possessing less than thirty (30) grams of any substance containing cannabis.
No person shall deposit, dump, throw or place any coal, ashes, dust, grass clippings,
branches, leaves, manure or rubbish in or upon any part of the Park System. Paper,
garbage or refuse matter shall not be so deposited except in receptacles provided for that
purpose.
No person shall tell fortunes, play at games of chance or use any gambling device in the
Park System.
No person shall manage, operate or engage in gambling of any form, in the Park System
No person shall have in their possession any clock, wheel, tape machine, slot machine,
pin machine or other machine or device for the reception of money or other thing of
value on chance or skill or upon the action of which money is staked, bet, hazarded, won
or lost. Any such machine or device shall be subject to seizure and confiscation.
No person shall trap, catch, wound or kill or mistreat or attempt to trap, catch, wound or
kill any bird or animal or molest or rob any nest of any bird or animal in the Park
System.
No person shall bring into or upon the Park System any tree, shrub or plant of any newly
plucked branch or portion of a tree, shrub or plant, without written approval of Park
District.
No person shall cut, break, climb on or in any way injure or deface any tree, shrub,
plant, turf or any of the, buildings, fences, bridges, lamps or posts or other structure or
property within the Park System.
No person shall trespass, stand, walk, ride or write upon any place laid out and
appropriated for shrubbery or grass when there shall have been placed thereon a sign
forbidding same.
No person shall cut, quarter, or remove any dying, dead or downed trees or shrubs from
Carol Stream Park District property without permission of the Director.
A person commits criminal defacement of property when the person knowingly damages
the property of another without his or her consent by defacing, deforming, or otherwise
damaging the property by the use of paint or any other similar substance, or by the use
of a writing instrument, etching tool, or any other similar device.
Criminal defacement of property is a Class A misdemeanor for a first offense if the
damage to the property does not exceed $500. Criminal defacement of property is a
Class ~ felony for a second or subsequent conviction or if the damage to the property
exceeds $300. In addition to any other sentence that may be imposed, a court shall order
any person convicted of criminal defacement of property to perform community service
for not less than 30 and not more than 120 hours, if community service is available in
the jurisdiction. The community service shall include, but need not be limited to, the
cleanup and repair of the damage to property that was caused by the offense, or similar
damage to property located in the municipality or country in which the offense occurred.
In addition, whenever any person is placed on supervision for an alleged offense under
this Section, the supervision shall be conditioned upon the performance of the
community service.
No person shall make, countenance or assist in making any improper noise, riot,
disturbance, breach of the peace or diversion tending to a breach of the peace in the Park
System or be guilty of any disorderly conduct therein or collect with other persons in
bodies or crowds for unlawful purposes or for any purpose to the annoyance or
obstruction or disturbance of other persons.
No person shall engage in behavior, speech, gesture or any offensive act, that provokes a
breach of the peace or disrupts, alarms, disturbs, intimidates, or unreasonably interferes
with others in the normal, safe use of the Park System or any facility thereof.
No person shall resist any commissioner, employee or police officer of the District in the
discharge of his/her duty or fail or refuse to obey any lawful command of any such
commissioner or police officer or in any way interfere with or hinder or prevent any
such commissioner or police officer from discharging his/her duty, or in any manner
assist or give aid to any person in custody to escape or to attempt to escape from custody
or rescue or attempt to rescue any person when in such custody.
No person shall falsely represent or impersonate any Park District Commissioner or
police officer or pretend to be a Park District Commissioner or police officer.
No person less than 17 years of age shall be present in the Park System, at or upon any
public assembly, building, place or roadway, at the following times unless accompanied
and supervised by a parent, legal guardian or other responsible companion at least 18
years of age approved by a parent or legal guardian or unless engaged in a business or
occupation which the laws of this State authorize a person less than 17 years of age to
perform:
Between 12:01 a.m. and 6:00 a.m. Friday and Saturday.
Between 11:00 p.m. on Sunday to Thursday, inclusive, and 6:00 a.m. on the following
day.
No parent, legal guardian or other person shall knowingly permit a person less than 17
years of age in his custody, to violate subparagraph (a) of this section.
No person shall start, fly or use fuel-powered, air-propulsion or electric-powered model
or toy or any radio controlled or powered toy or model, except at those Areas or Waters
designated by the Executive Director, as well as all applicable rules and regulations
administered by any federal, state or local agency responsible for
controlling such use.
It shall be unlawful for any person on any Park District property to:
use any type of sled in areas other than those designated for sledding
use any type of plastic food tray or similar device.
use any type of scoop shovel or car or truck hood.
sled with any device if there is less then two (2) inches of snow cover.
Any or all sledding areas may be closed when the area becomes unsafe due to lack of
snow cover or for other safety related purposes.
It shall be unlawful for any person to erect or build man-made jumps on any sledding
hill at any time.
It shall be unlawful for any person on any Park District property to:
ski or attempt to ski on any slope area set aside for sledding.
build any type of man-made jump for any purpose without prior approval.
It shall be unlawful for any person on any Park District property to:
enter on or upon any frozen waters to skate, fish, slide or walk or for any purpose
whatsoever upon such waters unless they are posted "open" or "safe".
fish through the ice on any frozen waters or parts thereof.
bring onto or upon the frozen waters of any lake, pond or watercourse any iceboat,
any motor, or wind-driven-like device or other vehicle, without permission of the
Executive Director.
No person shall engage in conduct which places another person in
reasonable apprehension of receiving a battery.
No person shall without legal justification cause bodily harm to, or make
physical contact of an insulting or provoking nature with another person.
No person shall obtain unauthorized control over property of another or by use of
deception to obtain control over property of another.
A person commits theft when he knowingly:
obtains or exerts unauthorized control over property of the owner,
obtains by deception control over property of the owner; or.
obtains by threat control over property of the owner; or.
obtains control over stolen property knowing the property to have been stolen by
another or under such circumstances as would reasonably induce him to believe that
the property was stolen; and
intended to deprive the owner permanently of the use or benefit of the property; or
knowingly uses, conceals or abandons the property in such manner as to deprive the
owner permanently of such use or benefit; or.
uses, conceals or abandons the property knowing such use, concealment or
abandonment probably will deprive the owner permanently of such use or benefit.
The Park System shall be open to the public from 6 A.M. to dusk unless different hours
are posted by the Board of Commissioners. No person shall remain in the Park System
when not open to the public except by permit from or contract with the Board of
Commissioners or the Executive Director.
Prohibited. No person, firm or corporation shall commit a trespass within the Carol
Stream Park District upon District property.
Specifically enumerated trespasses. Without constituting any limitation upon the
provisions of subsection (a) hereof, any of the following acts by any person, firm or
corporation shall be deemed included among those that constitute trespass in violation of
the provisions of said subsection (a): . An entry upon the premises, or any part thereof,
of the Park District in violation of a notice posted or exhibited or in violation of any
notice, warning or protest given orally or in writing by any Park District employee or
authorized occupant thereof; or
The pursuit of a course of conduct or action incidental to the making of an entry
upon Park District land or property in violation of a notice posted or exhibited or in
violation of any notice, warning or protest given orally or in writing by any Park
district employee or authorized occupant thereof; or
A failure or refusal to depart from the premises of the Park District in case of being
requested, either orally or in writing, to leave by any Park District employee or
authorized occupant thereof; or
An entry into or upon any vehicle or water craft made without the consent of the
person having the right to the possession or control thereof, or failure or refusal to
leave any such vehicle or water craft after being requested to leave by the person
having such right.
It shall be unlawful for any person to use a golf club to drive, chip, putt or otherwise
strike any object on Park District property, except in regular Park District programs or
by permit.
For purposes of this section, "organized gang" means an association, or part of said
association, of five or more persons with an established hierarchy, that encourages
members of the association to perpetrate crimes, or provide support to the members of
the association who do commit crime.
It shall be unlawful for any person to wear, use, or display any clothing, emblem, badge,
symbol, sign (either verbal or non-verbal) or other thing which evidences membership or
affiliation in any organized gang while on any Park District property or recreational
facilities owned or operated by the Carol Stream Park District.
It shall be unlawful for any person to solicit individuals for organized gang membership,
or intimidate any individuals for non affiliation in an organized gang, while on any Park
District property or recreational facilities owned or operated by the Carol Stream Park
District.
Any person who is found guilty in a court of law for violating any provision of this
section twice in any one-year period shall be banned from using the parks or recreational
facilities of the Carol Stream Park District.
Any person who has been banned from using the parks and recreational facilities under
this section and who refuses to remove himself or herself from the parks and recreational
facilities after requested to do so, shall be deemed to have violated Sec. 30 of the
Municipal Code of the Carol Stream Park District.
No person shall make any ascent or decent in a balloon, airplane, ultra-light, glider,
hang-glider, kite or parachute or any similar aviation device without prior written
permission of the Executive Director.
No person shall bring in or use any devise or instrument used to detect metallic objects
without prior written permission of the Executive Director.
All public ordinances of all municipalities within which any part of the Carol Stream
Park District is located are, hereby adopted by the Carol Stream Park District, insofar as
the same are applicable to the use of that portion of the park and park facilities of the
Carol Stream Park District located within the territorial limits of such respective
municipalities, as well as the laws, statutes and regulations of the State of Illinois. Said
municipal ordinances within that portion of the park district located within said
respective municipalities shall be deemed to be in addition to the provisions of these
ordinances, and violations thereof shall constitute violations of this section, and shall
subject the violator to the penalties provided herein.
Any person violating any clause or provision of any section of this ordinance shall be
fined upon conviction not less than Twenty-five Dollars ($25.00) nor more that Five
Hundred Dollars ($500.00) for each offense, the fine to be recovered in a manner and
form as provided by law. The Park District may also seek, in addition to said fines, an
order that the offender be required to make restitution for the damage resulting from the
violation, and the court shall grant such relief where appropriate.
This ordinance shall not be interpreted in any way to limit the Carol Stream Park District
from seeking any and all legal remedies available to it under criminal or civil law, and
the Constitutions of the State of Illinois and the United States of America.
